These Terms of Service ("Terms") govern your access to and use of the Exeqto website, mobile applications, and services (collectively, the "Services") operated by Exeqto Technologies ("Exeqto", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use Exeqto. Creators must provide accurate identity information and complete KYC verification before participating in campaigns. Brands and agencies must provide valid business information.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or security breach.
3. Creator obligations
- Provide accurate and truthful information about your identity, audience, and content.
- Complete KYC and tax documentation before receiving payouts.
- Honour campaign agreements and deliverables entered into through Exeqto.
- Do not manipulate engagement metrics, submit fraudulent data, or misrepresent your reach.
4. Brand and agency obligations
- Provide accurate business and payment information.
- Honour agreed compensation and payment timelines.
- Comply with advertising standards and disclosure requirements.
- Use creator data only for campaign purposes and not for unauthorized solicitation.
5. Exeqto Score and platform content
The Exeqto Score is a data-derived signal intended to help users evaluate trust and audience quality. It is not a guarantee of performance or character. We may update scoring methodologies at our discretion and do not guarantee uninterrupted or error-free service.
6. Payments
Exeqto may facilitate invoices, payment tracking, and tax documentation between parties. We are not a bank or payment processor; settlement may occur directly between creators and brands unless otherwise specified.
7. Intellectual property
Exeqto owns all rights in our platform, brand, and technology. You retain ownership of your content but grant us a license to use it as necessary to provide the Services. Do not copy, modify, reverse-engineer, or resell any part of Exeqto without our written permission.
8. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraud, or create legal risk. You may terminate your account at any time by contacting us.
9. Limitation of liability
To the fullest extent permitted by law, Exeqto is not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability to you shall not exceed the amount you paid to Exeqto in the twelve months preceding the claim.
10. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
11. Changes to terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
